AI Gary

Terms of use and risk disclosure

Version 1.0, the version in force. You accept these terms in AI Gary itself: once you are signed in it asks for them before anything else, and again whenever they change.

Please read this. It is the whole agreement between us about AI Gary, and it replaces the data and privacy note you may have been shown when you joined the beta. It does not replace the terms of the platform you sign in through, and it does not replace anything you agreed with The Norden Method about the course itself.

In this document, references to “we”, “our” and “us” mean Organic Financial Group Pty Ltd (ACN 142 666 162), which runs AI Gary. You means you, the person using it. The Norden Method means the programme you are learning from. Your instructor means the person who teaches The Norden Method.

About AI Gary

Before anything else: the risk

Trading futures carries a substantial risk of loss and is not suitable for everyone. You can lose more than the money you put in. Past results do not predict future results. Do not trade with money you cannot afford to lose.

AI Gary and The Norden Method promise you no result. Not a profit, not an improvement, not a passed evaluation.

Every figure AI Gary shows you about your trading describes trading that has already happened: yours, and in the room block and on the Community tab other people's. No figure about your trading is a projection, a forecast, or a promise about what comes next.

There are three places where AI Gary talks about the market instead of about you, and you should know them before you read anything else it writes. The first is a calendar. AI Gary carries a fixed calendar of scheduled economic releases, quarterly expiries, roll weeks, market holidays and thin liquidity seasons, and around those dates it tells you what the method does: that the tape into a scheduled number is usually violent and the method stands aside into it, that a roll week is a stand aside until the roll completes, that a summer or year end stretch is usually slower and thinner. Those lines come from a calendar and a clock. They are general expectations attached to a date, not predictions of price, not advice, and not a reason to place or avoid any particular trade.

The second is the market around your trades: how far price ran after your exits, which Bookmap's export also records, and, where the addon recorded the market, how price drifted, how the order book stood and who was crossing the spread in the seconds before each fill, read as with you or against you. These are past seconds from your own data feed, they can include your own orders on a live account, and they are not an exchange record. The order book's lean at the best price is shown only on ES, the one instrument where our own measurement, small and open to revision, found that price moved next toward the heavier side a little more often than not; on every other instrument the book is shown as sizes only. The third is Today so far, the read you ask for on your dashboard, which can describe a day on which the room's rate is clearly below its usual as slow or choppy, and staying out as the adjustment. None of this is a prediction of price, a signal, or advice to place or avoid any particular trade.

Access to AI Gary

You may use AI Gary while you hold an AI Gary plan at The Norden Method's school or a membership there that includes it, or under an invitation from us until we end it. Your account is not closed automatically when any of these ends, and we may then end your access. Our plans and their prices are available at https://nordenmethod.com/program/ai-gary; the plans' names, prices and billing shown there form part of these terms, and nothing else on that page does.

Australian residents must not access AI Gary. Organic Financial Group Pty Ltd does not hold an AFSL and therefore this website is not intended for Australian residents. Organic Financial Group Pty Ltd is not registered with any US regulator including the National Futures Association ("NFA") and Commodity Futures Trading Commission ("CFTC")

By using AI Gary, you acknowledge and represent that you are not an Australian resident. We may request proof of a user’s country of residence, and reserves the right to deny access to anyone who cannot provide such information (and in particular, who cannot provide information that they are not Australian residents).

What AI Gary is

AI Gary reads the trades you closed, as Bookmap's own export or our addon recorded them, and, on each instrument where you tick the addon, each of your orders within seconds and that instrument's market.

Code, not a model, computes The Norden Method's rules over those trades and produces the findings and the Norden Method Score. A language model then writes the words you read: the note during a session, the pre-session brief, the Today so far read on your dashboard, the chat replies and the debrief.

So: the numbers are computed, and the sentences are written by a model. A model can be wrong about a sentence. A check now blocks a note whose verdict contradicts the computed result, but it reads wording and will not catch everything. Read the numbers.

Four things on your screen are not readings of your own trading: the calendar described above, the warnings built from it, the market around your trades, and the room's figures, on the Community tab and in the room block of your Today so far read, which come from the traders who count in the room, you among them if you count.

What AI Gary does not do

AI Gary is not a broker, trading or investment advisor. It is not a futures commission agent or merchant. Its content is educational in nature.

AI Gary does not manage money. It never sees your broker credentials, never connects to your broker, and cannot place, change or cancel an order.

It never tells you what to trade. No instrument, no direction, no price, no entry, no exit, no target. Nothing it produces is financial advice, a recommendation to buy or sell anything, or a signal, and you must not treat it as one.

AI Gary does give you instructions about your own conduct, and some of those instructions are loud.

  • It tells you to stop. Four of the method's rules fire an alert that says to stop trading now: four losing trades in a row; giving back half of the session's peak profit, once that peak has passed a minimum the product sets; a trade whose heat, meaning how far it ran against you before it closed, reached the instrument's large band and was more than it ever ran your way, and then another one like it, on an instrument with confirmed bands; and any daily loss limit you set for yourself, counted down from the session's best point, so profit you give back counts toward it. Only the last of those four is a line you drew. The other three are the method's and the product's, and they fire whether or not you have set anything. Each alert reads one session at a time: one instrument on one account, cut at midnight on your computer's clock when the addon records it, and with Bookmap's own export one recording, which starts again whenever Bookmap restarts. So two instruments that each stay inside your limit can together lose more than it without an alert, and losses split between them fire no streak alert. The two alerts that read dollars stay silent on a session whose dollars are marked unverified, as described below. A trade over 250 contracts or beyond $50,000 stays in your list, in your export and in the platform's own totals the dashboard repeats, but no total, rule or alert that AI Gary works out counts it.
  • It tells you to stand aside. Around a scheduled release, before it and for a few minutes after; during a roll week; and when today's own trades carry the method's chop signature, in which case it reads the market as not giving the method's conditions. The thresholds behind that last read are the product's own, and the product itself calls them provisional.
  • It can suggest a figure for your own daily loss limit. If you ask about your limit, or if your limit sits well above your typical profitable day, the chat is instructed to suggest moving it toward a figure computed from your own history, and to show you both numbers. That is a suggestion about a setting inside AI Gary. It is not a trade.

All of that is about your conduct and your settings. None of it is an instruction to enter a trade, and none of it is a promise that stopping, standing aside or moving a limit will make you money or protect you from a loss. Stopping when it says stop, carrying on when it says nothing, and what you do with your own limit are your decisions, every time.

The software you install

The connector starts each time you sign in to your computer. From the day you installed it on, it sends the trade files it finds in the addon's folder and in Bookmap's export folder, and the addon's own files: your order events within seconds, and each market file about every half hour and again each time it starts. The pairing code you give it works as its key and does not expire, so keep the code and the connector's settings file private. The connector installs our new versions by itself, and a new version can change what it sends, until you set "auto_update" to false in its settings file and restart the connector. Neither the connector nor the addon is code signed yet, and while updates are on, a faulty version can reach your computer without you doing anything.

Bookmap and your market data

Bookmap has not signed the addon, and Bookmap decides whether an unsigned addon runs on your data feed. Your market data reaches you under agreements with your data provider and the exchange, and those agreements can restrict sending it anywhere else, even in summary. With the addon ticked on an instrument, a per second summary of that instrument's market leaves your computer and we store it, and so does the market inside your order record: the best bid and ask at each of your order events and, each second an order of yours rests, the size resting and traded at its price. We have not confirmed that your agreements allow this, so check them before you tick an instrument.

What you are agreeing to:
  • Every trading decision is yours, and so is every consequence of it, whether profit or loss.
  • You will not treat anything AI Gary produces as financial advice or as a recommendation.
  • You accept that AI Gary can be wrong, in its wording and in its reading of a rule, and that acting on it is still your decision.
  • You accept that an alert to stop or to stand aside is a reading of rules and of a calendar, that following it or not following it is your decision, and that neither choice moves the consequences of it onto us.
  • You remain responsible for following your broker's rules, your prop firm's rules and any rules that apply to you where you live.
  • You agree that the connector installs our new versions until you switch that off.
Where the numbers can mislead you

Being honest about this is part of the point.

  • Your score can change without your trading changing. The Journal computes it when you open the page, so an old day reads differently if The Norden Method changes the score or an instrument's bands, if that day's trades or their analysis change (a late order or market file can do this), or if you change your commission settings. The copy the Community tab keeps is not frozen either: it is rewritten when that day's trades or analysis change, though not when your commission settings do, and after a change to the scoring a day can be missing there until it is worked out again.
  • A score is refused rather than guessed. If the trades behind a session did not all arrive, the row shows a dash instead of a number, and says why.
  • On an instrument with no confirmed bands, the size of an error cannot be read at all. Only the rules can be judged, and that day can never read 100.
  • Commissions are corrected only if you enter your rates. Without them the numbers are whatever your platform reported, distorted in one direction or the other by the account.
  • Trades Bookmap sends to another contract. With Bookmap's cross trading, an order placed on one chart can trade another contract, for example MNQ from the NQ chart. Bookmap's own export names the contract you traded. The addon records the chart's contract, so for the addon's trades AI Gary needs the route, which it learns from the addon's order record: when it knows which contract that chart trades, it records them in that contract, with its dollars, alerts and export; when it does not, it keeps them but leaves their dollars out of your totals, marked US$ unverified, until you name the contract in your settings. Until a session's order record arrives, AI Gary cannot tell whether it was routed: a route that stands for its chart prices it as routed, and with none it is priced, totalled and alerted in the chart's contract until the record arrives and the session is written again, which can take up to a day; if the record never arrives, a standing route lapses at the next daily check and the session's dollars are marked US$ unverified. A session whose order record holds both routed and direct trades is priced as routed throughout, so its direct trades carry the wrong dollars, or none if the route is unknown. Ticks and times are right either way.
  • A trade recorded twice. When Bookmap's export and the addon both record the same session, its trades count once if one copy holds every trade of the other. Where neither does, for example when the two copies disagree on a trade or, in live trading, do not name the same account, the trades they share count twice, as they can in the simulator or in replay and for up to a day while one copy is still arriving. Both copies stay visible.
  • An instrument the addon is not ticked on. The addon records nothing about it. Its trades reach AI Gary only if Bookmap's own export records them, and then with no order or market readings; otherwise AI Gary never sees them, and no total, rule or alert covers them. Nothing warns you either way.
  • Missing data can look like clean execution. Older days, and some simulated environments, arrive without fill times. The Journal marks those days as scored without fill data and leaves them out of the month's average, but an absence is still not a good result. A market reading that is not shown may never have been measured, or may be held back for that instrument or by your plan; either way, it does not mean the market was calm.
  • The room's rate is not all live trading. When your Today so far read compares today's rate in the room to usual, that pool currently counts simulator sessions and replays of past days alongside live ones. A replay is filed under the market day it replays, so a replay of any day in the last four weeks counts toward the usual rate whenever you play it, an older one counts toward neither, and only a replay of today's market counts toward today's.
  • AI Gary is for futures only. A session in anything else is refused and not analysed.
Services, pricing and availability

Our fees for using AI Gary are payable in advance of your access to AI Gary commencing. Subscriptions renew at the end of their duration, unless you elect to cancel. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct services, not different services altogether.

AI credits

Once credits show in your menu, each coaching read costs the number of credits shown there, charged once the read is saved. You ask for every read except the notes: each trade you close on a coached session, simulator included, gets a note that costs a credit, a trade that counts twice gets a note and a credit for each copy, and nothing turns the notes off while your connector is sending. A plan's credits, and those of a membership that includes AI Gary, which counts as Essential, cover a calendar month in UTC and do not carry over; if you change plan during a month, what you used counts against the new plan; without either you have none. A plan, membership or top up bought at the school counts here only once you have opened AI Gary from your course, which links the two accounts. A top up is used after the month's credits run out, lapses twelve months after it is added, even if that is before credits are switched on, and does not open a read your plan does not include. Credits are not money and are not paid back.

Your privacy & data

What we collect
  • The trades your connector uploads: the closed trade export from your platform, with instrument, side, prices, entry and exit times to the millisecond, holding time, time to fill, excursions, profit and loss, commission and ticks, plus the session summary. The export also carries the account identity string, which can name your prop firm or your broker account. We keep every accepted upload exactly as it was sent.
  • If you install the addon: on each instrument you tick, every order event at the millisecond, placements, changes, cancellations and fills, with the account label and, when it has a current one, the best bid and ask at that instant. While an order of yours rests, a line each second on its place in the queue, and your closed trades as the addon writes them. And a market file for each instrument you tick, for each second it is open in Bookmap, whether you trade or not, stamped with your computer's clock and your data feed's clock: the best bid and ask with their sizes, the sizes on the nearest price levels, and that second's totals of depth, trades and volume, never the raw feed. The market file never marks anything as yours, but on a live account its figures can include your own resting orders and fills.
  • About your connector: its version, when it last uploaded, and the uploads we refused.
  • What you enter: your name, your email, your password, your personal daily drawdown limit, your commission rates per instrument and account, and your settings.
  • If you arrive from the course: the signed sign in message from the school, which carries your user id there, your email and your name, and which we store whole. We also ask the school which of its courses and products you hold, and keep each whole answer, which lists everything you hold there, with names. And when the school tells us something about you unprompted, such as a purchase, an enrolment or its end, a trial, or a subscription that started, was paid, was cancelled or changed, we store your user id there, your email, what kind of message it was, its date and which products it names, never the amount or how you paid, including from the messages whose signature did not check out. If you buy an AI Gary plan or a top up, this starts on that day, before you first open AI Gary.
  • Counters: how much you have used, and a record of each model call, its cost and how much text went in and out, and your AI credits: those used each month, every top up, and any credits added by hand, with the reason.

We do not collect your broker credentials. We do not sell your data. We do not use it for advertising. AI Gary's own pages load no analytics, no advertising pixel and no third party script, and AI Gary's own cookies only keep you signed in and remember your display preferences. A tutorial you open plays in a frame from an outside tutorial service. Its viewer analytics are switched off for AI Gary, so it sets no cookie, adds no identifier and records none of your steps, clicks or time, though it keeps copies of its own player files in your browser, and an identifier it stored before the switch was turned off stays there, unused. Like any website, it and the companies that host and monitor its pages receive your network address and browser details, and they receive nothing from your AI Gary account.

Who can see it

You. Your own dashboard, journal, notes, briefs, debriefs and score.

Your instructor and the people who run AI Gary. There is one administrator level and no separate instructor role, so an administrator sees the back office for every student. Your consent to share decides what they see there:

  • What your consent gates: your dashboard, your journal, your execution and community views, and the no login link to your dashboard. Turn sharing off and access ends immediately, including for anyone holding an old link. Your plan does not limit what they see, a debrief they order about you sits with yours and does not use your credits, and they may contact you about what they see.
  • What your consent does not gate: the roster and what support needs. Every student is listed there by name and email with their activity counts, which of three stop rules (four losses in a row, giving back half the day's peak, their own loss limit) their live sessions hit in the last fourteen days and the day of the last one, the state of their connector and uploads, their support tickets, their plan, credits, purchases and AI cost, what the school told us about them, which agreements they accepted, and whether they count in the room or withdrew, whether sharing is on or off. Switching sharing off does not make you invisible. It withholds your trades from the back office.

Outside the back office, the people who build and maintain AI Gary can reach the database and the stored files directly, your chat included, whatever your sharing switch says. They use that access to repair data, to answer support and to measure the product: some thresholds every student sees were set by measuring students' uploads, and tests of the models can send real sessions, without a name or an email, from a copy of the database to the model provider. They also work with an AI assistant from that same provider, which reads what they look at in the database, names and chat included.

Today, agreeing to share with your instructor is required to create an account. You can switch it off at any time afterwards, from your account settings, and keep your own dashboard.

Every account has an unguessable web address that shows that student's dashboard without a login, used for embedding and for support. It stops working when you switch sharing off, and it is replaced when you delete your trading data. You cannot currently see or change your own.

Other students, as anonymous shapes. The Today so far read you ask for on your dashboard can include a block about the room: the best trade shapes of the day, and how today's rate compares to usual. A shape carries the instrument root, ticks per lot, size, hold time, time to fill and heat, and nothing else: no name, no time of day, no profit and loss figure, though its size and ticks let someone who knows the instrument work out roughly what it made, and at most one shape per person. The room is read only when at least five other traders who count traded that day, and the room line counts trades and days, never people. Your trades feed other people's blocks and the Community tab only if you agreed to be counted in the room's figures, a separate and optional agreement you can withdraw at any time on the Community tab or in your account settings, and the room's figures you see are built only from people who agreed to the same. Know two things plainly: this flow is not controlled by the switch that shares with your instructor, and it lowers the chance of being identified without being anonymity in any formal sense.

On the Community tab, the traders who count make up medians and rates for each instrument over the three complete months before the current one, live and simulator apart and replays left out, with bands that place your recent sessions against them. Nothing prints for an instrument until six traders who count have traded it that way, with a hundred and twenty sessions between them and nobody above 35% of them, and the tab never shows a name, an account, a session, a dollar figure, how many people are in the room, or a rank. A band is not a verdict, and its ticks are before any commission correction. Counting includes the months already stored, and stopping takes all of them out of what the room works out from then on. While your sessions do not count, the Community tab does not show you the room's figures.

Who else processes your data

By role, not by brand, because these can change:

  • A model provider, which receives the computed findings and the trade and session data each surface needs, plus your recent history and recent chat messages for the chat, and, when you ask the support assistant, your question and the facts about your account it needs to answer. We do not add your name or your email to what we send, though the pre-session brief, the debrief and the chat carry your account label or the names of your export files, which can contain it, and if you count in the room, the shape of one of your trades can go out with another student's Today so far read. What you type into the chat is sent as you typed it, so do not type or paste into it anything you would not want a processor to hold.
  • A hosting provider, which runs every page and request and holds the server logs.
  • A database and storage provider, which holds everything else, including your account.
  • The course platform, which signs you in and tells us what you hold and buy there. At our request it removes a top up you bought from your list there; that is the only change AI Gary's software makes there.
  • An email sender, which sends the emails AI Gary sends: the link to reset your password, and notices about a support ticket: that we have written on it, that we think it is sorted, and where a reply you sent to a closed ticket went. A notice carries the ticket number, and a link to it when you opened the ticket signed in, never the answer itself. The same provider receives your replies to those notices and passes them to your ticket, and it tells the people who run AI Gary that a ticket needs them, with a number and a link, no name and no message text.
  • A tutorial service, which plays the walkthroughs in a frame when you open one and sees that visit, as described above.

The database and storage provider keeps your data in the United States, and the model provider is a United States company. Backup and test copies of the database are also kept on a maintainer's computer in Colombia.

How long we keep it

Market files: fourteen days, swept by your own uploads. The sweep runs on your uploads and on nothing else: each time we store a new or grown market file of yours, those more than fourteen days older than it are deleted. That mirrors how long the addon keeps them on your own machine. There is no scheduled job. Your connector sends the files on your computer again each time it starts, but a file we already hold is not stored again and sweeps nothing. So if no new market file of yours arrives, because you uninstall, revoke your token or stop opening Bookmap with the addon ticked, the market files from your last days stay where they are until you delete your trading data or your account, or someone deletes them by hand, and one deleted by hand comes back the next time your connector starts if your computer still holds it. What AI Gary read from a market file stays after the file is gone: the order book and pace around each trade stay with that trade, and the day's price every thirty seconds and its trades and contracts each second stay in our record of the file, until you delete your trading data or your account.

Everything else: until it is deleted. Your trades, analyses, notes, briefs, debriefs, chat, raw uploaded files and course platform records have no automatic expiry today. This is stated plainly rather than dressed up as a policy.

Support messages: one year after the ticket is closed, then their content is deleted and only the count of tickets is kept.

Getting your data out, and getting it deleted

You can, today, from inside AI Gary:

  • Export your own trades as a spreadsheet file: from your settings, the last twelve months or any year you traded, on every plan; from your Journal, any month it shows. The file holds trades only, not order events or market files. It carries no name and no email, so you can hand it to anyone without handing them your identity, though it does carry the account label your platform recorded, which can name your prop firm or your broker account.
  • Clear your chat with AI Gary. Those messages are deleted outright.
  • Have your connector's access revoked. There is no button for it yet: ask on the Support page, or delete all your trading data or your account, which revoke it as well. A connector token does not expire on its own, so ask if a machine leaves your hands.
  • Switch off sharing with your instructor.
  • Change your password.

You can also delete your data yourself. In your account settings, under Your data, you can delete sessions by mode and date range, delete all your trading data, or delete your account. Sessions and trading data are deleted at once. Your account is deleted thirty days after you ask, and until then you can call it off by signing in and choosing to keep it. You can also write to aigary@nordenmethod.com and a person will do it for you.

What deletion does not remove

Deleting your account removes a great deal: your sessions, trades, analyses, notes, briefs, debriefs, chat, the raw uploaded files, the market files, the daily counters of your AI use, the record of what your use cost, your AI credits, unspent top ups included, and the records the course platform sent us that can be matched to you all go with it, and your login goes straight after them, on the same day. It happens thirty days after you ask. It does not remove everything, and this is the rest.

  • Some of what the course platform sent us: the deletion finds the school's records by your account, your user id at the school and your email, so a record whose only trace of you is somewhere else inside the message is not matched and stays. If the school deletes you, nothing tells us.
  • Anonymous shapes already written into another student's saved room block, which are not rewritten.
  • Our hosting provider's request logs, which are outside our software.
  • The record of what you accepted: which document, which version, a fingerprint of its exact words, the moment, the network address the acceptance arrived from, a one way fingerprint of your email address, and the id of your account, which then points at nobody. It stays because AI Gary is about trading live futures, and the proof that you were shown the risk has to outlast the account. It is removed only if you ask us to remove it.
  • Backup copies of the database taken before the deletion, kept outside AI Gary so that it can be rebuilt after a disaster, any backups the database provider keeps on its own schedule, and the repair files we keep of rows we changed, which carry no name or email. We restore from a backup only to rebuild AI Gary after a disaster, and a rebuild from a copy taken before your deletion would bring your data back. A copy is also sometimes restored elsewhere for tests. Our own copies have no automatic expiry: each one goes when it is deleted by hand.
  • What was already sent to the model provider that writes your analysis and answers in the chat. It sits outside AI Gary, on their schedule rather than ours. We never add your name or your email to it, though your account label or the names of your export files can carry your name, and whatever you typed into the chat went as you typed it.

Deleting only some sessions is a different thing again, and you should know what stays:

  • A marker stays, and it has to: your account ID, the date of the deletion, and a one way fingerprint of a key built from the first trade of that session, so the trade cannot be read back out of it. Without the marker your connector would upload the same files again on its next start and the deletion would undo itself.
  • Some uploaded files stay: the upload each deleted session was built from is deleted, but earlier copies of the same uploads, and the order and market files your addon sent, which are filed by day rather than by session, stay until you delete all your trading data.
  • The cost record stays, with the session's name removed from it.

General terms

Support

Support is on the Support page in AI Gary. An assistant answers from the help articles first, and when it cannot help, you open a ticket. If you are signed out, the same page has a form. You can also write to aigary@nordenmethod.com, which both of the people who run AI Gary read.

What you write on the Support page becomes a ticket with its own number and its own page, where you can read it and answer it, and it moves through its states until we close it. An email to the address above is read by a person, but it does not open a ticket by itself.

We email you when your ticket moves. When we write on your ticket, and when we think it is sorted, you get an email with the ticket number and, if you opened it signed in, a link to it. The answer itself stays on the ticket, not in the email; a ticket opened without signing in has no page, so we answer it by email at the address you gave. If you reply to that email, your reply lands on the ticket, and a reply to a closed ticket opens a new ticket that continues it, which we email you about. If you already have three tickets open, that reply is not kept, and we email you to say so.

Support messages are read by a person: the people who run AI Gary, and your instructor if your instructor is one of them. The support assistant is a model and can be wrong. What you ask it reaches the model provider as you typed it, with no name or email added by us, so leave out anything you would not want a processor to hold. Do not paste anything into support you would not want read, and please remove anything from a log or a screenshot that you do not want us to have. We do not promise a response time. A year after a ticket is closed, its content is deleted and only the count of tickets is kept.

You do not get the right to copy, publish, resell or hand on the Norden Method Score, AI Gary's software or the words AI Gary writes for you, or to use any of it to build a competing product. What you may do with the method itself is subject to the terms of the course you agreed to with The Norden Method, and these terms do not change it and add nothing to it.

How you may use AI Gary

Your account is yours alone. Do not share your login. Do not pass on a no login link. Do not upload someone else's trading data as your own. Do not try to reach another student's data, and do not try to get around the product's limits or its safety rules. Do not use AI Gary to give financial advice to anyone else.

In particular, you must not use AI Gary to:

  • use or engage with any material which is defamatory, obscene, abhorrent, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable;
  • promote sexual or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  • infringe any patent, trade mark, trade secret, copyright or other intellectual property or other rights of any other person;
  • mislead or deceive any person;
  • promote any illegal activity, or advocate, promote or assist any unlawful act;
  • cause annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person;
  • impersonate any person, or misrepresent your identity or affiliation with any person or organisation, including with us;
  • involve content such as contests, sweepstakes and other sales promotions, barter or advertising;
  • give the impression that any content emanates from or is endorsed by us or any other person or entity, if this is not the case;

Similarly, you agree that you must not generally use AI Gary:

  • in any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from other countries);
  • for the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise;
  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with the content standards set out above;
  • to transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter” or “spam” or any other similar solicitation;
  • to impersonate or attempt to impersonate us, any of our employees, another user or any other person or entity (including, without limitation, by using email addresses associated with any of the foregoing); or
  • to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of AI Gary, or which, as determined by us, may harm us or users of AI Gary or expose them to liability;
  • use AI Gary in any manner that could disable, overburden, damage, or impair AI Gary or interfere with any other party’s use of AI Gary, including their ability to engage in real time activities through AI Gary;
  • to infringe any patent, trade mark, trade secret, copyright or other intellectual property or other rights of any other person.

Additionally, you must not:

  • use any robot, spider or other automatic device, process or means to access AI Gary for any purpose, including monitoring or copying any of material on AI Gary;
  • use our intellectual property or any content on AI Gary as a non-fungible token (NFT) or an immutable digital asset intended for sale or other distribution;

  • use any content on AI Gary for the development of any software program, including for the purpose of machine learning or training an artificial intelligence system;
  • use any device, software or routine that interferes with the proper working of AI Gary;
  • introduce to AI Gary or to any other user any viruses, trojan horses, worms, logic bombs, spyware, computer code, file, program or material which is malicious or technologically harmful;
  • attempt to gain unauthorised access to, interfere with, damage or disrupt any parts of AI Gary, the server on which AI Gary is stored, or any server, computer or database connected to AI Gary;
  • attack AI Gary via a denial-of-service attack or a distributed denial-of-service attack; or
  • otherwise attempt to interfere with the proper working of AI Gary.

We may report any of the activities above to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use AI Gary and our services will cease immediately.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to AI Gary constitutes a violation of their intellectual property or other legal rights, or of their right to privacy.

Availability

AI Gary can be unavailable. There is no uptime commitment. Analysis can be delayed, can fail, or can arrive incomplete. What is here today can change or be removed. We accept no liability for any disruption or non-availability of AI Gary resulting from external causes including, but not limited to ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

Your use of the AI is limited. Each person has a daily limit that resets at midnight UTC, and once credits show in your menu, they are your allowance under that limit. Some plans do not include every read, and the notes have limits of their own, such as a hundred replay notes a day. A ceiling on the AI cost of all traders together in a UTC day stops replay notes first, then simulator notes, then every coaching read for everyone until midnight UTC, even while you still hold credits. When a limit is reached, the written reads stop and the screen says so; a stopped read costs nothing, and the rules and their alerts keep working. That includes the notes during a live session: the feed says they are paused and what brings them back.

Warranties

Other than as expressly set out in these terms, AI Gary is provided as is and we exclude all rights, representations, conditions, warranties, guarantees, undertakings, remedies or other terms in relation to AI Gary to the maximum extent permitted by law.

Changes to these terms

We can change these terms at any time. When these terms change, you will be shown the new version and asked to accept it before you carry on. We will not change them silently.

Ending this

You can stop using AI Gary whenever you like, and ask for your data to be deleted in accordance with the relevant provisions of these terms.

You buy, change and cancel your plan or membership at the school, not in AI Gary, and deleting your AI Gary account neither cancels it nor removes you from your course. Stopping, or a plan ending, does not close your account or delete anything by itself: your connector keeps uploading and we keep what it sends, and your sharing and your counting in the room stay as you left them. Once plans are in force, a plan ending takes away its credits and the reads and tabs it opens, and your screens show only the last ninety days; nothing older is deleted.

Without affecting any of our other rights, we may suspend or terminate your access to AI Gary, or terminate your account with immediate effect by giving written notice to you if:

  • you no longer have access as described under Access to AI Gary
  • you fail to pay any undisputed amount due under these terms on the due date for payment;
  • another clause of these terms provides that we may terminate; or
  • you commit a material breach of any of these terms and you fail to remedy that breach within a period of 14 days after being notified in writing to do so.

If we terminate your account for these reasons, we will cancel any AI Gary payment not yet taken, such as your next renewal, and your data stays until it is deleted.

Termination does not affect any rights, remedies, obligations or liabilities of the parties that have accrued up to the date of termination, including the right to claim damages for any breach of these terms that existed at or before the date of termination.

Limitation of liability

Nothing in these terms excludes, restricts or modifies any condition, warranty, right or liability implied or protected by law to the extent that such exclusion, restriction or modification would render these terms (or any provision of them) void, illegal or unenforceable. Subject to that:

  • We do not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of AI Gary or any linked website, nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through AI Gary;
  • any condition, warranty, right or liability which would otherwise be implied in these terms and conditions or protected by law is excluded; and
  • except in relation to liability for personal injury (including sickness and death), we do not accept liability to you in respect of any loss or damage (including indirect, special or consequential loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly in respect of goods or services supplied pursuant to or in any way connected with AI Gary or in respect of any failure or omission on our part to comply with our obligations as set out in these terms.

In any event, to the maximum extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of AI Gary or any information contained in it.

Pursuant to section 64A of the Australian Consumer Law (under the Competition and Consumer Act 2010 (Cth)):

  • this sub-clause applies in respect of any of the goods or services supplied under these terms which are not of a kind ordinarily acquired for personal, domestic or household use or consumption, provided that this sub-clause will not apply if you establish that reliance on it would not be fair and reasonable;
  • liability for breach of a guarantee conferred by the Australian Consumer Law (under the Competition and Consumer Act 2010 (Cth)), other than those conferred by ss 51 to 53 of that Law, is limited:
    • in the case of goods, to any one of the following as determined by us:
      • (A) the replacement of the goods or the supply of equivalent goods; or
      • (B) the repair of the goods; or
      • (C) the payment of the cost of replacing the goods or of acquiring equivalent goods; or
      • (D) the payment of the cost of having the goods repaired;
    • in the case of services, to any one of the following as determined by us:
      • (A) the supplying of the services again; or
      • (B) the payment of the cost of having the services supplied again.

If any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed and will not affect the validity and enforceability of the remaining terms. This applies only within jurisdictions where a particular term is illegal.

Indemnity

Except to the extent caused or contributed to by the negligent act or omission, wilful misconduct or breach of these terms by us, you indemnify us against any direct losses, liabilities, costs, charges or expenses and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses suffered or incurred by us for any claims brought by a third party against us to the extent arising out of or in connection with:

  • your use of AI Gary in a manner that breaches these terms; or
  • any allegation that your use of AI Gary or your trading data infringes, or involves an unauthorised use or disclosure of a third party's intellectual property rights,

provided that you may not settle any such claim against us unless we consent to such settlement, and further provided that we will have the right, at our option, to defend ourselves against any such claim or to participate in the defence of any such claim by counsel of our own choice.

Governing law and disputes

These terms and the relationship between us are governed by and construed in accordance with the law of Western Australia.

We aim to resolve disputes and concerns quickly with you. In the first instance, you agree to first contact us about any dispute or complaint using the contact details below.

You agree to submit to the exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.

The rest of the standard terms

These terms are between you and us. No other person has any rights to enforce any of these terms.

Any forbearance, delay or omission to exercise any right under these terms must not be construed as a waiver of that right in either the present or on any future occasion.

If the whole or any part of a provision of these terms is or becomes invalid or unenforceable under the law of any jurisdiction, it is severed in that jurisdiction to the extent that it is invalid or unenforceable and whether it is in severable terms or not.

We may assign or transfer our rights and obligations under these terms to another entity, but will always notify you in writing prior to this happening.

Accepting these terms, and the record of it

You accept these terms by pressing the button that says so. Every account is asked the first time it opens AI Gary after these terms are in force, and again whenever they change.

Sharing your trading data with your instructor is a separate tick. One is agreeing to these terms. The other is agreeing to the sharing described above, which today includes your dashboard, your journal, and your execution and community views, and which is separate again from a third agreement of its own: counting your sessions in the room's figures, which is optional and which you can withdraw at any time.

When you accept, we record who accepted, the moment they did, the network address the acceptance arrived from, and a fingerprint of the exact version of this text you were shown. That record is only ever added to. It is never edited and never overwritten, and it is removed only if you ask us to remove it.

If these terms change, your old acceptance keeps pointing at the old words, and you will be asked to accept the new version before you carry on. Until you have accepted the current version, the only page you can reach is the one that asks, and on that page you can still export your own trades, switch off sharing with your instructor, delete your data or your account, and sign out. Declining a new version of these terms never takes those away from you, and your connector keeps sending your trades while you decide, so you do not lose your own record of those days. Meanwhile the notes are still written and, once plans are in force, still charged, and if sharing is on, staff can still see your screens.
